New ‘Sellers Disclosure Regime’ coming into effect 1 August 2025 under Division 4, Part 7 of the Property Law Act 2023 mean that Buyers will be provided new disclosures by the Seller.
The purpose is to help buyers make an informed decision and reduce post contract disputes. Previously a ‘buyer beware’ scheme was implemented, but that is changing.
Currently, Sellers have to provide:
- Title Search
- Pool Safety Certificate or Notice of Non Compliance
- Smoke Alarm Compliance
- Body Corporate Disclosure (if in a Body Corporate)
- Warning Statements in the Contract
As of 1 August, the Seller will need to provide:
- Title Search and Lot and Plan Information
- Current zoning under the planning act, statutory notices, tree orders, heritage listings
- Building Structures including owner builder work, show cause, enforcement notices and pool compliance
- Rates and Services, copies of notices
- Community Management Statement and Body Corporate Certificate
Buyers need to be aware that the Form 2 does not cover everything and still need to conduct their own due diligence.
